Services for Companies Employing Foreigners

Comprehensive HR and legal support for hiring foreign employees

Work Permits

Employing a foreigner in Poland requires obtaining the appropriate work permit -- unless the employee is exempt from this obligation under special provisions. We help companies prepare and submit applications for type A work permits (most common), type B (for board members), C, D, and E (employee posting).

We conduct a full legal analysis of the planned employment -- we verify whether the foreigner holds the appropriate residence title authorizing work, whether a labor market test (starost's information) is required, and what conditions must be met for the application to be approved.

We prepare complete documentation, submit applications on behalf of the employer based on a power of attorney, and monitor proceedings until the decision is issued. In case of refusal, we prepare appeals. We serve companies from across Poland -- both large corporations and small businesses employing individual workers from abroad.

Declarations of Entrusting Work

The declaration of entrusting work to a foreigner is a simplified work legalization procedure available to citizens of selected countries (including Ukraine, Belarus, Georgia, Moldova, Armenia). The declaration allows for legal employment for up to 24 months without the need to obtain a work permit.

The declaration registration procedure is faster than obtaining a work permit -- the district labor office has 7 business days to enter the declaration into the registry. We help with correctly completing the declaration, verifying employment conditions, and submitting documents at the labor office competent for the employer's registered office.

We pay particular attention to the compliance of conditions specified in the declaration with actual working conditions -- discrepancy may result in sanctions for the employer. We also advise on transitioning from a declaration to a work permit and combining a declaration with an application for a temporary residence and work permit (the so-called single permit).

Payroll Administration

Employing foreigners involves additional HR and payroll obligations. The employer must correctly determine the employee's tax residency, apply the appropriate income tax rate (20% flat rate for non-residents or progressive scale for residents), and take into account the provisions of double taxation avoidance agreements.

We offer comprehensive HR and payroll services for foreigners -- from drafting the contract to monthly payroll calculations, generating pay slips, filing ZUS and tax declarations. We also prepare annual IFT-1R forms for non-residents and PIT-11 forms for tax residents.

We maintain personnel files in accordance with labor law requirements, monitor the validity dates of residence documents and work permits, and inform the employer about approaching deadlines requiring action -- such as submitting an application for a work permit extension.

B2B Cost Optimization

B2B cooperation with foreigners through the FDK business incubator is an effective way to optimize employment costs. Instead of a traditional employment contract that generates high employer costs (ZUS, OHS training, medical examinations, leave), the company receives a single VAT invoice for services provided by collaborators.

The B2B model through the incubator is particularly attractive for foreigners because it does not require establishing their own business in Poland, registering with CEIDG, or independently managing accounting. The FDK incubator takes over the formalities -- the worker uses the Foundation's legal personality and settles accounts within a single subscription.

For the employer, the benefits are measurable: reduction of employment costs by up to 30-40%, simplified formalities (one B2B contract instead of multiple employment contracts), the ability to deduct VAT from the invoice, and no risk related to the Labor Code. We prepare individual savings calculations for every company interested in this cooperation model.
