ANNEX 2 TO THE RESIDENCE CARD

19/10/2023

Appendix 2 – Residence Card – when should it be completed? What conditions must be met?

Annex 2 to the residence card is a document that is essential when a foreign national applies for a temporary residence permit in Poland to work in a profession requiring high qualifications for a period longer than 3 months.

But when will a foreign national actually be eligible to receive such a permit? Here are the conditions that must all be met:

  1. The conclusion of an employment contract for a period of at least one year, an outwork contract or a civil-law contract (the annual gross remuneration under this contract must not be less than the equivalent of 150 per cent of the average wage in the national economy in the year preceding the submission of the application);
  2. Possession of the formal qualifications and other requirements necessary to practise a given regulated profession;
  3. Possession of higher professional qualifications;
  4. Possession of health insurance or confirmation that an insurer will cover the costs of medical treatment within Poland;
  5. Possession of authorisation from the competent authority to hold a specific post, practise a specific profession or carry out other activities (where the obligation to obtain such authorisation prior to concluding a contract arises from statutory provisions).

In addition to the above, the entity entrusting a foreign national with the performance of a given job must, as a general rule, be unable to meet its staffing needs on the local labour market.

Appendix 2 to the residence card – how to complete it?

Are you a foreign national applying for a temporary residence permit in Poland to work in a profession that requires high qualifications, and do you meet all the above conditions? Annex 2 to the residence card is the document you should complete. How do you do this? Here is a brief guide.

In Annex 2 to the residence card, you must first specify in detail all the professional qualifications you hold that are necessary to carry out the job in question, including, in particular, the type of these qualifications and the type of document certifying them.

In Annex 2 to the residence card, you must also provide details regarding the so-called ‘EU Blue Card’, i.e. the document permitting you to reside in a Member State of the European Union. You must specify the country in which you have resided for a period of at least 18 months, the exact duration of your stay, as well as the series and number of the document issued and the authority that issued it.

Finally, you must also state the date on which you completed Annex 2 to the residence card and sign it by hand.

Annex 2 to the residence card – template

A template for Annex 2 to the application for a temporary residence permit can be found, amongst other places, on the website of:

  1. the Podlasie Provincial Office in Białystok (LINK: https://www.gov.pl/web/uw-podlaski/formularze-wnioskow-do-pobrania2);
  2. the Department for Foreigners’ Affairs of the Wielkopolska Provincial Office in Poznań (LINK: https://migrant.poznan.uw.gov.pl/pl/do-pobrania/zalacznik-nr-2-do-wniosku-o-zezwolenie-na-pobyt-czasowy-wysokie-kwalifikacje-niebieska);
  3. The Department for Foreigners’ Affairs of the Mazovian Provincial Office in Warsaw (LINK: https://migrant.wsc.mazowieckie.pl/pl/do-pobrania/zalacznik-nr-2-do-wniosku-o-zezwolenie-na-pobyt-czasowy-wysokie-kwalifikacje-niebieska).

The templates available for download from the websites listed above are just a few examples of the documents constituting Annex 2 to the residence card, which can be found on the websites of the Provincial Offices. In principle, however, they are all similar, so you can safely download any template of your choice and use it when applying for a temporary residence permit in Poland to work in a profession requiring high qualifications.
