Polish immigration law is complex and constantly changing. Foreigners face challenges related to interpreting the provisions of the Act on Foreigners, the Act on Employment Promotion and Labor Market Institutions, and numerous implementing regulations. Our legal team specializes in these areas and provides comprehensive advice.
We assist with matters relating to visas, temporary and permanent residence permits, work permits, declarations of entrusting work, the EU Blue Card, the Polish Card, and Polish citizenship. We analyze each client's individual situation and select the optimal strategy for legalizing stay and work.
We monitor changes in regulations and inform our clients about new rules that may affect their legal situation. We offer legal consultations in Polish, English, Ukrainian, and Russian -- both in person at our office in Warsaw and online.
Employer Contracts
Foreigners working in Poland often do not know their rights under Polish labor law. We help analyze and negotiate employment contracts, mandate contracts (umowa zlecenie), contracts for specific work (umowa o dzielo), and B2B contracts. We verify whether employment conditions comply with regulations and do not violate employee rights.
We advise on matters concerning minimum wage, working hours, leave, notice periods, non-compete clauses, and employee data protection. In the event of disputes with an employer, we assist with mediation or prepare claims for the labor court.
We pay particular attention to the compliance of employment conditions with the conditions specified in the work permit or declaration of entrusting work. Discrepancy between actual conditions and those declared in legalization documents may result in the revocation of the residence permit -- we help avoid this.
Appeals Against Decisions
A negative decision regarding a residence permit, work permit, or citizenship is not the end of the road. Polish law guarantees a foreigner the right to appeal an unfavorable decision to a higher-instance authority, and subsequently to an administrative court. Our team specializes in preparing effective appeals.
We analyze the reasoning of the negative decision, identify procedural and substantive errors of the first-instance authority, and then prepare an appeal to the Head of the Office for Foreigners or another competent second-instance authority. In the appeal, we present additional evidence and legal arguments supporting a change of the decision.
If the second-instance decision is also unfavorable, we prepare a complaint to the Voivodeship Administrative Court, and if necessary -- a cassation complaint to the Supreme Administrative Court. We represent clients at court hearings and ensure all procedural deadlines are met.
Representation Before Government Offices
Visiting a Polish government office can be a stressful experience for a foreigner -- language barriers, complicated procedures, and long waiting times are everyday reality. We offer full representation before voivodeship offices, district labor offices, ZUS (Social Insurance Institution), tax offices, and other public institutions.
Acting on the basis of a power of attorney, we act on the client's behalf -- we submit applications, collect decisions, supplement formal deficiencies, and participate in hearings and explanatory proceedings. The client does not have to appear at the office in person, which saves time and eliminates the stress associated with formalities.
We monitor the progress of administrative proceedings, keep track of statutory deadlines, and respond to authority inaction. In case of delays, we file urgency notices, and if that does not produce results -- complaints about inaction to the administrative court. Our goal is to resolve the matter as quickly and favorably for the client as possible.
